Shipping Laws, Title Transfer & Tax
Shipping and import laws change frequently. Some states permit wine shipments statewide, others only to certain counties, and some do not permit them at all. If you place an order on our website, we will verify whether shipping is possible. Your order may be canceled, or you may choose to pick it up at our California location using a carrier of your choice. Your order is not accepted until your credit card is processed and the order has been shipped. An authorization is not an order; authorizations expire if not charged.
We do not ship to certain locations, including Alaska (outside Anchorage), Kentucky, Mississippi, South Dakota, Utah, and others. If you are unsure whether we can ship to your address, please contact us. We make no representation regarding the rights of customers to import wine into states outside of California.
Title Transfer and California Sale: By placing an order through this website, you acknowledge and agree that the sale of any alcoholic beverage is made and completed in the State of California, where King Frosch / Bellinghausen Business Group Ltd. holds its alcoholic beverage license. Title to all wine and risk of loss transfer to you, the buyer, upon tender of the wine from the common carrier. For orders placed by customers located outside the State of California and shipped to destinations outside the State of California, title to all products and risk of loss pass to the buyer upon delivery to the buyer's designated address in the destination state. These transactions are completed upon delivery in the destination jurisdiction.
Buyer as Principal / Agency for Shipping: By placing an order, you hereby designate King Frosch / Bellinghausen Business Group Ltd. as your agent solely for the purpose of engaging a common carrier to deliver your wine.
Sales Tax: Sales of wine shipped to destinations outside California are interstate sales and, as such, are not subject to California sales and use tax. You, the buyer, are solely responsible for all applicable excise, use, and sales taxes due to your own state in connection with the importation, receipt, or use of the wine.
Buyer Responsibility for State Law Compliance: Various states impose limitations on the quantity of alcohol that may be purchased or imported without requiring the purchaser, seller, or shipper to possess certain licenses or permits. You are strongly advised to investigate such limitations and to determine the manner in which alcohol may lawfully be brought into your state. By placing an order, you represent that you are acting in full compliance with your local and state laws regarding the purchase, transportation, and delivery of alcoholic beverages, and that you have obtained any required permissions and paid any required fees.
All returns must be made in accordance with California law; returns across state lines are not permitted.
If your order cannot be fulfilled in a normal time frame due to state restrictions, it is your responsibility to advise us whether you will arrange your own carrier. If you have your own FedEx, UPS, or other account, you may email us a prepaid shipping label. Shipping and handling fees are included with your purchase unless otherwise indicated.
